I130. US citizen filing for spouse

Longer than most other countries 

 

If you’ve been married less than 2 years you don’t want this to move too fast because you don’t want to deal with I-751.

Yeah we have been married for less than 2 years. We got married September of 2021

Please complete the timeline and ID the country / it helps if u want answers from the others going thru Casa embassy

 

A CR 1 spouse visa will take 2 years or more so i suggest u get the baby's passport (as directed in other posts) and take the baby to see the father 

this extra visit will help your case 

 

Add your spouse to 2022 tax returns to show u have started to commingle assets as u married 

casa knows this can be done

Ok thanks. Yeah I’m planning to add him to the 2022 return I  also added him to the 2021 tax return already.

this spouse visa will take about 2 years so as soon as u can , take the child and visit Morocco 

 

or plan to go to be emotional support for his interview even though u can't be inside the embassy for it

BUT if u can;t go,   he will need originals of the documents u scan to CEAC to NVC site during next step

 

When u get ready to send the original documents for his interview,  i found USPS overnight the best /  not really overnight as it will take about a week but cheaper than the over hundred dollars the other services want

Yeah I was planning to go for the interview with him. With my luck I’m afraid to go and then approving it and me having no way to send everything to the nvc haha. I never knew it took this long. Because before it wasn’t taking as long then they said because of Covid but that ended already. I wonder why it takes this long?

If the visa is issued before the 2 year anniversary of  your marriage, and if the expiration date of the visa is after your 2 year marriage anniversary, then he should delay  entering the U.S. until the  2 year marriage anniversary.  
 

Visas tend to expire 6 months after the medical examination and the medical examination tends to be several weeks or less before the interview 
 

Similarly you should delay filing I-864 to ensure he doesn’t have to enter the U.S. before your two year marriage anniversary.  
 

I can imagine the above runs counter to what your heart wants but it is best to avoid I-751

Good advise as if he comes after your 2nd anniversary (september of 2023)  he gets the 10  year green card 

and since u are not yet to NVC,   its a good possibility

So if he gets approved for his interview and let’s say it was in may or June then delay enters to the USA until after September? They would automatically give him the 10 year?

Legally he would have to be issued a 10 year gc. Sometimes mistakes are made, but even with a mistake he would file I-90 for free versus paying to file I-751.

Timeline

The NVC stage is very fast right now. It only took us 45 days to be “Documentarily Qualified”, i.e., ready for an interview appointment. US Embassy Casablanca sends out interview letters only a few weeks after the NVC stage is complete.
 

After your approval, if you upload all the correct documents to the NVC and become case complete from the first time, you won’t have to wait much. You’re SO close, and so very lucky that your husband is in Morocco and not a country where waiting for an interview date takes a year!
 

Study the reciprocity documents schedule for the country of issuance of each civil document on nvc.state.gov/find, and start compiling the financial evidence you’ll need for the I-864. Familiarize yourself with the NVC stage before it arrives.
