The military card is only needed if he DID serve in the military, which he didn’t. Everything mentioned in the website has a purpose. Read carefully what is and isn’t needed. If you haven’t been married before, then you won’t be able to produce a divorce certificate out of thin air. Same with a military card. Same with a death certificate.

Under 29 doesn't tell us much

How old is he?

he is under obligation per (Algeria 1974a, Art. 1) to do military service

If older than 30,  he is exempt so will he have 30 birthday by interview

list of documents needed for spouse visa in Algeria is found on following site

https://travel.state.gov/content/travel/en/us-visas/Supplements/Supplements_by_Post/ALG-Algiers.html

for Algeria it says the following

If you have served in any country’s military: Military records, English translation, and a photocopy.

He is 26 and not served military time so he will not be older than 30. So does he need to go to the military first before he does an interview or receive some sort of exemption

I understand that already. That isn't the question I am asking. I am asking if he needs to go to the army and serve military time before his interview.

Obviously he does not have a military card because he did not serve in the military yet. But I am asking if that one of the requirements to receive his green card because Algeria mandates that male should serve military time. Or can he do his interview without the military service and be okay. Thank you for the answer, but honestly the only people who can answer this question are Algerians who understand the military laws of Algeria and went through the interview process.

It can be as it is a requirement of Algeria

What are the concequences if a man does not serve?

He knows

have u tried to call US algerian embasssy in DC to ask?

or the contact form to ask US embassy in Algers

  • If you have a pending Immigrant Visa petition, but the case is not yet scheduled at the U.S. Embassy in Algiers, please use the on-line NVC Contact form.

But the US doesn’t. Why would the US care about what Algeria mandates? The US doesn’t recognize dual citizens, btw. It allows them but does not care about what the American citizen’s (or immigrant’s) other country says.

To ease your mind…. There’s plenty of Syrian male beneficiaries here asking how to get a police certificate from Syria for the NVC/interview, when Syria does not issue them for military deserters. There’s a waiver for the PCC in that case. Why? Because the USA does not care about another country’s military mandates!

He called the US embassy in Algers and the person he talked to didn't even know what documents were needed for an interview.

In algeria a lot of people dodge the service, punishment is honestly by luck. You can go your whole male adult life and not be called for service. You can be called for service but not be enforced to go. Or you can be called for service and they will literally have military personnel sent to your home to drag you out. So the formal punishment is "have you serve a year of military time" but that isn't enforced well and is enforced randomly that a lot of people age out.

Ive been trying to read around but its really hard to find information. I found some people who said they were asked about it in their interview and was told to show an exemption. I had other asked that they weren't asked at all. My husband asked a someone the other day and the guy said they only ask for the diversity visa and K1 visa. but all this information just seems very inconsistent

our Algerian friend (here in the US) had the letter of exemption as one leg is shorter than other

he says his wife sent it in with CEAC supporting documents and he took original to interview but the CO never asked to see it

so ,  who knows,  if the CO who does interview is Algerian hire by embassy ,  they may consider it important

if the CO is USC maybe not as important

when u call the embassy ,  u don't get the person who knows  about interviews  / that's why u need to do the contact form
