Denied AOS petition, please help!

Hello,

 

My wife's AOS petition was denied because she was unable to provide a long form birth certificate when the USCIS requested for it.

 

We applied with consular affairs (South Africa) to recieve the document but the processing time is a minimum of 6 months.

 

After receiving the confirmation and processing time of the long form birth certificate, we submitted the confirmation when replying to the request for evidence but we're denied. 

 

What do we do in our situation and how can we appeal this and make sure it doesn't get denied and/or get enough time to recieve her birth certificate.

 

There must be something we can do and any help is greatly appreciated. Thank you.

Could have just paid someone down in S.A to get it for you. 

 

$5 greasing palms is all you needed. So, I'd suggest you go ahead and do it and reapply AOS. You cannot reopen this case. It's closed. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Agree with this. If I had $5 dollars every time I had to spend $5 dollars greasing palms thru this process it would have been much cheaper. LOL

NOA as of 4/29/24 - Oath Ceremony scheduled for May 30th in Chattanooga, TN. Rescheduled as of May 2nd, 2024 by USCIS - new date is May 29th.
May 29th - Naturalized! Ta-da!

Possibly. I assume the K1 is expired, so yes. However, overstays for USC immediate relatives are forgiven (Hope that OP is indeed a citizen!)

Timeline

USCIS forgives. BP and ICE don’t.  Once BP or ICE enters the picture, USCIS loses jurisdiction to immigration court.

N your response to the RFE, IDid you ask for extension of time stating delay was beyond your control? 
 

How/what  did you write in response to RFE…?

 

Am curious to see if they are now denying res quests for more time

Just FYI, this could happen if she’s out of status. Therefore it does make sense to keep filing AOS so that at least she’s in a period of authorized stay
