Brainstorming Ideas on how to proceed

Hello!

I am a naturalized USC and wants to marry a lady who is abroad (in India).

Looking at options -

  • I  can get her to the US on the K1 Visa but the wait time is 9-15 months
  • I can get her to the US on a visitor visa but the waiting time to get a visa is almost in 2024!

 

I am thinking of getting her a visitor visa to Canada and from there getting a visitor visa to US since it will be quick? will this work?

Please advise.

Or you can go visit her, get married there and start the spousal visa process. 

Why are you looking into a visitor visa if the plan is to have her move to the US?

No.

 

Go about it the right way and petition her for the proper visa.

 

The petition phase for the K-1 is 15.5 months currently.  Either fiance or spousal visa will take two years.

 

There is nothing fast, or cheap about US immigration, and she can't come here on a visitor visa to live permanently anyway.

Thanks @Daphne . - How long is the waiting time for the spousal visa? Is it shorter?
I was only looking at visitor visa since the waiting times were higher for K1. Please advise.

K-1        
    More expensive than CR-1    
    Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
    Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months)    
    Spouse can not work until she/he receives EAD (approx 6-8 months)    
    Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
    Spouse will not receive Green Card for many months after Adjustment of Status is filed.
    A K-1 might be a better choice when 18-21 year old children are immigrating also
    In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice   
    A denied K-1 is sent back to USCIS to expire


    CR-1
    Less expensive than K-1    
    No Adjustment of Status(I-485, I-131, I-765) required.    
    Spouse can immediately travel outside the US    
    Spouse is authorized to work immediately upon arrival.    
    Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
    Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
    Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The processing times are what they are.  There are no shortcuts.  Yes, it's possible that she can enter the U.S. during processing; see the "Yes, You Can Visit" pinned threads.

If she has a visitor visa then she can travel to the US  for a visit .. but each entry is at the discretion of the CBP officer at POE… it seems from your first post, however, that she does not have a visitor visa already.. her application for a visitor visa would take as long as the immigration process. Have you met in person?

None of them are fast, you need to look at the options you have. It is the K1 or the CR1 (that is the spousal visa and these take anywhere  around 18-24 months).

 

The visitor visa is not an option because that is not an immigrant visa.

You don't just get to pick the visa based on the processing times. You need to apply for the appropriate visa for the purpose of her travel. She can't immigrate on a visitor visa.

There is no “quickest.”   The process will take a couple of years.  She cannot legally live in the US while waiting out the process.

@TBoneTX - Thank you for the responses, Looks like CR-1 visa suits my needs. I have met her when I was there for two months and we have been talking after I came back to the US. I plan to go in Feb and marry her but my biggest fear is that after i marry here i can't bring her for 2 years or so. But if I can bring her while the CR-1 is processing then I am fine. Is that the case? Please advise.

I am fine to do the CR1, just don't want to be separated from her during the processing time. That was why I was thinking at alternative options.
