Hi! I wanted to check and see how you are doing in the process and if you had any issues with visiting your spouse in the US? Thx! We still have not applied as I really do not want us to be apart but know that if I move back first it seems a bit easier (no domicile/sponsor stuff).

You don’t have to move back to the US before filing the I130/a. The first part of the process takes about 12 months and you don’t have to live in the US to petition someone. The domicile requirements are required at NVC stage. This is when you would start making moves to return to the US. Read the Canada thread to keep up to date with domicile requirements out of Canada.
There is no need to live in different countries for 18-24 months. If you had filed in December/January nothing about your life would have changed except you would have started your process to move to the US.

Still waiting. :) I have my interview scheduled, coming up in less than 2 weeks. If all goes well I'm hoping to be reunited soon after that! It's been a long process, but that being said, it took me awhile to get DQ'd because they decided to require a joint sponsor. (Probably added a month to six weeks to the timing).

And, I did visited twice without any issues. I ensured that I had all documents that indicated I WAS returning, including:

-Return flight ticket

-Return shuttle ticket (from airport to home)

-Letter from my employer indicating I am still employed here + most current paystub

-Previous i-94 information indicating/proving that I have never overstayed my time limit

Upon crossing the border both times I was only asked to see the return flight ticket. But you can never be too careful.

Nice! I hope the interview goes well, and you are able to move soon!

We just finally started to do the paperwork this weekend. Still no clue what we will do, if I will move back first or we wait and move together.  In the meantime we will keep visiting the states together, we usually go over and shop in MI every week. Thanks!
