Timeline

We received an RFE today for our I-485 Adjustment of status.. I'm pretty confused on what the issue is and how to fix it.. I attached the letter we got.. any help is appreciated

Looks like you didn't submit the most recent tax year (2021) documents with your I-864 and the same for your joint sponsor.

 

Also, your joint sponsor's income does not qualify for sponsorship.  It may be related to the missing tax documents.

Seems like,

 

1. the petitioner (person who filed I-129F) needs to provide their entire tax year 2021 tax return. 
 

2. you need a new joint sponsor who earns enough money. W-2 income is preferred.  So you need a new I-864 for that new joint sponsor. 
 

3. new joint sponsor needs to provide the entire 2021 tax return 

 

4. need a copy of new joint sponsor’s U.S. birth certificate or green card or American Samoan birth certificate 

 

5. current income is king. The joint sponsor should provide evidence of current income such as gross pay stubs

for K1 joint sponsor only needed 100% of poverty level income

for AOS ,  its 125% 

 

u need to find a joint sponsor who qualifies with 125%

 

the items to show sponsor qualifies are spelled out (proof of USC or LPR)

other items to show are I 864 affadvit and supporting W2

a 1099 would be for income doing contractor work

1099R is for SSA income (if new sponsor is retired)

form 2555 is used by taxpayer for foreign earned income to use the tax exempt allowed by IR

 

 

all that from a joint plus your most recent (2021) tax returns and a new I 864 and the supporting W2 or any 1099 or any 2555 u supplied to IRS

It's difficult to help you if you don't tell us what you originally submitted. You're making everyone just guess what the issue could be.

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Sorry I've been working or I would have responded quicker.. I submitted last 3 years(2019, 2020, 2021) tax transcripts for myself and my joint sponsor, 4 months pay stubs, w2s, letter of authorization from employer.. the one thing I'm sure I missed was proof of citizenship for my joint sponsor.. I'm sure that I sent everything needed to show proof of income.. that's why the letter confuses me.. I am seeing that he didn't qualify because his income isn't enough(he made just over the amount needed).. but then they are asking for proof of his citizenship.. I plan on making an appointment with the office, I'd like to be as prepared as I can be when I go there
