Validate my thinking here: renew GC vs apply for citizenship

This is a question about timing.  My wife's first GC expires in May.

 

We have a wedding to attend in Bali in July.

 

I'm thinking we should renew the GC rather than go for citizenship at this time.  Would you agree?

What's the Resident Since date on your wife's GC? Is expiration date exactly 2 years after Resident Since date?

 

How long have you been married when wife got her GC?

 

She may need to file I-751 to remove conditions. She cannot skip this step if her residency is conditional.

Based on your timeline, your wife has a 2-year GC.  GC renewal is only for those with a 10-year GC.  2-year GC holders are not eligible.  Your wife must file I-751 to remove conditions within the 90-day period before the expiry date on her GC.

 

Also, your wife will not be eligible to file for citizenship until 3 years after the "Resident Since" date on her GC.  Sort out her I-751 ROC filing first.

I agree, based on your timeline you appear to have a 2 yr GC as if it was a 10 yr it would not be expiring.  File the I751 (do not submit an I90 as it will be a waste of money), get the extension letter and head to the wedding.

Oath Ceremony:  2018-06-11 - DONE!!!!!!!

You’re going to file I-751 in the spring.  When you do they will send your wife a letter extending her green card.  You can fly out and return using the expired green card and that letter.

Make sure you don’t time it so she misses her biometric appointment.

She got her green card in 2021?  She can file for citizenship on the three-year rule in 2024.

5/30/2021 to 5/30/2023

 

We'd been married since 7/25/2019.

 

Sounds like I-751 is our route, thank you.

Just to add to what others have said, your wife won't be eligible to apply for citizenship until 03-01-2024 at the earliest (90 days before her three year anniversary of becoming a permanent resident/"resident since" date on her card). This is assuming she remains married to you.

06/27/2017: NOA1 (technically a RFE as we were missing beneficiary ID)

07/06/2017: NOA2

07/12/2017: Case assigned by Juarez embassy

07/17/2017: Packet 3 received

08/15/2017: Interview/Approval!

08/22/2017: Visa received via DHL

09/03/2017: POE

09/16/2017: Permanent Resident Card received

 

Total days from NOA1 to approval: 49
