Hi Community,

So I came to US in Feb 2020, now in Nov. I became eligible to file for N400 application (Married to a US citizen so 3 year rule applies). I submitted the application yesterday.

Now the question is I only have 2 years of tax returns, 2020 2021& we cannot file 2022 returns yet. Is there going to be a problem with this or I can just take the third year tax returns to my interview?

Just to make sure, you were married for over 2 years when you entered the US in Feb 2020? E.g. you have 10 year green card?

Then yes, no problem with your tax returns for 2020 and 2021 only.

Thank you for the response. Yes, I was married in 2017 and have a 10 year green card.

Per the N400 instructions, the tax return information is not required evidence for filing, but rather evidence needed for the interview.  File now, (or when your window opens) and by the time your interview comes around you will most likely have the 3rd year (same circumstances as my wife).

Good Luck!
