LPR Allowed to DCF?

Hi,

 

Are LPR’s allowed to DCF?

Specifically a LPR parent petitioning for his/her underage/unmarried child through I-130.

A part of DCF is that the petitioner is a resident of the foreign country and needs to relocate to the US on short notice due to unforeseen circumstances.

 

An LPR needs to reside in the US.  If an LPR tries to DCF,  I would imagine their US residency would be questioned.

 

An exception may be for those in military service/deployment.

You’re right … though I should have mentioned this is for an Afghan. Afghans are currently exempt from the residency requirement.

 

So … hence the question, can an LPR parent petition via DCF for a minor child?

No, sorry.  Only US citizens filing for an immediate relative (IR categories) can request approval from an Embassy/Consulate to file an I-130. Others with urgent needs shouId file the I-130 with USCIS and request an expedite. See (especially Footnote 4)  https://www.uscis.gov/policy-manual/volume-6-part-b-chapter-3.
