Divorce and resumption of maiden name

I am filing for divorce tomorrow, I have everything ready as I’m needing to get it done before my removal of conditions is due in Feb (I know I’m leaving it late, it’s been a crazy year). Anyway, if I choose to do the resumption of maiden name alongside the divorce, how does that affect my green card/ conditions of removal? Should I be updating all those documents immediately with my new name (maiden name) or can this wait as I’ll need to apply for conditions to be removed and hopefully get approved for a 10 year GC?

You cannot change your name while filing I-751 unless you have official name change document. So, as of now, you'll have to file with your married name. 

 

Now, since I-751 would have been filed by the time your divorce is done, I wouldn't bother about changing the name on my GC till N400 so that you do it for free. What I mean is, your 10 years GC will come with your married name as that's what you filed it under. You can send it back and change it, but $$. So, why bother while you can get it done for free when you file N400. When you file N400, since you will have your official name change by then, go ahead and file with your maiden name. Free.

Since you are filing for ROC with divorce waiver, you may use your maiden name on the I-751.  Your final divorce decree (which you must submit anyway) will serve as your legal name change document.  If you do not revert to your maiden name during ROC, your next opportunity to do so will be at naturalization, or you will have to petition for name change through your state court.

The Divorces I've been through its usually noted on the decree that wife has option to take her maiden name back. That is your permission. It costs money though so if your decree is filed with your ROC you should be able to change it then. If not wait to N400 time. dont forget about state DL or ID and SSN credit cards and all those little things.
