CR-1 Process/Brazil

Hi, there, and thanks in advance for any help!

 

I was originally planning on beginning the K-1 process for my fiancée.

However, after reading experiences and advice around here, it seems the CR-1 might be the better route for us.

I'll be traveling to Brazil again in February for a few months, and provided that we do decide on the CR-1 route, we do intend to marry there.

 

Hoping to hear from anyone who (or whose partner) has gone through the CR-1 process from Brazil, in case there might be anything out of the ordinary that I might be missing. Any tips regarding the marriage certificate would also be appreciated.  

 

If I understand right, I would want to send the I-130 application as soon as returning from Brazil, as seen on the Assembling the I-130 Package: Checklist.

You can send it or file it online while you are still in Brazil.

No.  It can also be sent by courier to a street address in the USA from anywhere.  Where are you getting these ideas?  Time to become an A-Student of the actual form instructions, downloadable from the same place you get the form, any form.

I thought I had read that here. I must have misunderstood.

Have your fiancée go to the local cartório and get info on what you need to provide and if it needs to be translated.   I remember for RN I had to get an FBI form from the Criminal Justice Information Services division showing no arrest info.    I had to get a CPF before getting married.  I had do a single status affidavit,  take it to a notary public,  and then get the secretary of state to apostille it.  And i had to get an apostille for my birth certificate.   All while Covid-19 was new....

The process for a non-Brazilian citizen or resident to marry a Brazilian in Brazil is a long and bureaucratic headache.  I did it, so I'm very familiar with how to do it, prior to filing an I-130 petition to begin the CR-1 spousal visa process.  You will need to get all US civil documents such as your birth certificate and divorce decree (if any), apostilled by the state in which it was issued (a hassle and expense) before you go to Brazil in February, and take them with you.  Those documents will then need to be translated in Brazil by an official translation service that is recognized by the Brazilian government (more time and expense).  Once all the civil documents are ready, you and your intended spouse will go to the local cartorio where you want to get married and fill out a marriage application and both sign it.  After that is done, there is a one or two month waiting period before you can actually get married.  If you will be in Brazil for at least 3 months, it may work out.  If not, I suggest doing a Utah Zoom marriage while you are in Brazil, as it is fast, simple, and much cheaper.  Feel free to DM me.  Good luck!

Btw, if your wife changes her name,  make sure she also notifies the INSS (after getting the updated RG).   Btw, the cartório will help getting the documents to the translators (who I found their website was not available much).
