Age is Running Out

Hello everyone,

I understand that a child must be in  America before he or she turns 21 years. My daughter (IR2) will turn 21 years next year and we have been waiting for our interview since she was DQ in October 2021 and my DQ in January 2022.  

 

My question, can we ask NVC to expedite our case for this reason and secondly is there sample anyone can help me with.

My read of https://www.uscis.gov/green-card/green-card-processes-and-procedures/child-status-protection-act-cspa is that the age is frozen when I-130 is filed.  
 

Thus,

 

1. no age out for your daughter’s case 

2. no basis for expedite

Thank you for your response but please can you throw more light to this. I really didn't understand even after reading the link.  

 

Do you mean if she turns 21years  she cannot longer get the visa . Please more explanation.

If you were under the age of 21 at the time the petition was filed, you are eligible for CSPA and will not age out. However, you must remain unmarried in order to qualify.”

Can we enter US after Daughter turns 21years in June. Due to some much we have to do, we might not be entering until 2nd week in June which will be after her birthday.  Hope it wont affect her during entering. Spouse is us citizen for more info.

 

I am so sorry for repeating this question, but I am just trying to understand and be more careful.  I have read the child protection over and over but still didn't really understand.

So first you wanted an expedite before she turned age 21, and now “never mind”?

 

She can use her visa until it expires, but why in god’s name would you take that risk? This is her last chance.
