Sorry it is AOS I-485.
Was just notifying that my background was coming from K1.

Right, I knew what you meant.  Like I said, it is unusual to get RFEs for that.

Sorry to hear you're going through this, and also relieved that it's not only me. I also just saw on my uscis that they sent a RFE for documents which I already submitted. Funnily enough, I also submitted the AOS from San Jose (but recently moved to NY, not sure if that has any effect on how the AOS is processed though)

My RFE this time is requesting 1: a copy of the marriage certificate within 90 days of the K-1's arrival in the US, and 2: evidence of a lawful admission or parole into the United States, e.g. I-797, I-94, and passport pages, and I definitely know I included those in my original package that I sent in January.

To show evidence of lawful admission or parole into the United States, I will include the I-797, I-94, and passport page scans of the biographic page, K-1 visa page, and entry stamp page using K-1 visa. She also has an advance parole, so should we also include a scan of the advance parole, and passport page scans of additional entry into the US?

Also, my immigration lawyer recommended sending everything by mail and not by using the uscis website, but I'm not sure if that's just because he's old school and hasn't had experience with the website or if there are cases where the website has caused delays, does anyone know about downsides of responding to the RFE by website instead of mail? I'm currently out of the country and won't be back for another month.

Hi everyone,

So in summary: I got a RFE for my K1 AOS to show marital evidence since my wedding date, and one of the points they add was to add some sworn affidavits from friends and family.
I understand that this is not as strong as the other evidence, but I would just like to add this regardless.

I have searched this forum, but there were 1 or 2 threads about it but not really solid.

I would like to ask:

1. Does the family member or friend HAVE to have had attended the wedding?
I did not have a wedding party, only the ceremony during Covid where 2 people were allowed (spouse's parents came only). But I did meet up with spouse's cousin after that for a photoshoot.
(I was going to have a wedding party in my country after approval of visa.)
Was thinking of asking cousin because spouse's parents first language is not English and it will be easier with cousin.

We were also going to ask my spouse's friend who knows we got married but only met a couple of times and have pics.
Again, no pics at wedding because I had no wedding party as of yet.

2. Do these have to be notarised?
I do not see any info that they have to be but I am unsure. Read in another thread that notaries don't notarize these sort of things.
I have attached an image of what is being stated on the RFE.

Thank you for any help and I hope my thread will be useful to others in the future too.

1. Not necessary that they attended the wedding. Those signing the affidavits simply have to be able to attest to the validity of the marriage. This can come from anyone that has legitimate, first-hand experience with the two of you as a married couple.
2. Sworn affidavits, by their very nature, are usually notarized, yes. I’d say err on the side of caution and have the affidavits notarized. Google “[your state] notary acknowledgement sample” and add it to the end of an affidavit form you’ve done up for whomever is gonna sign for you. If there’s a notary acknowledgment that mentions having taken an oath (I.e. sworn), that’s the one you want. Most banks, check cashing places, and even UPS stores have notaries. Just my $0.02 worth as a (non-immigration) lawyer going thru this process too.
