221g revocation-Still no answers

Petitioner: US CItizen

Beneficiary: Afghan National

Embassy: Islamabad Pakistan

 

My fiance received a 221g white form at this interview. It just said sent back to USCIS for revocation no reason or answers.

 

The embassy in Islamabad keep telling me the case was sent back to USCIS and to contact them within 6-8 weeks. Which I did.

USCIS claims then claims they don't have anything returned to them & to contact Dept of State or Embassy.

Embassy then states its with NVC and to contact them within 6-8 weeks. Which I did.

NVC states case is with the Embassy still.

 

So as you can see I am in a hell of a loop. Did anyone else have this experience or know of a way I can get answers ASAP. I'm tired of waiting for answers. I am tired of spending so much time being away from my loved one, money, energy. At least if I can get answers but this is just ridiculous this run around.

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

99.9% the petition was sent back to USCIS to die.

 

1. How long have you known your fiance?

2. How much time have you spent with your fiance in person.

3. Are you of the same religion.

4. Have you met each others' families.

5. Is there a large age difference?  

 

 

The trend for Islamabad for K1 approval is the requirement of very strong relationship evidence.  Light evidence that could pass in London or Paris will be denied out of hand there.

 

The recommended path forward is for you two to marry, spend 2-3 years with each other as much as possible, and pursue a spouse visa.

Just age difference. Im in my early 30s and hes in his early 30s. Im not that concerned on why it was sent back but more wanting to know if anyone has had this issue where they havent heard back from Embassy, NVC or USCIS while their petition was being sent back and if they contacted their senate or someone else to push for an answer.

We were born in the same country, have the same religion. I know it was because of the age gap because the CO after hearing im in my 30s and hes in his 20s he just said that was unusual and gave him that white form. 

 

Yea Im hearing bad things about embassy in Islamabad. Unfortunately we cant spend that much time together as he lives in Afghanistan and our country is going through the Taliban taking over. I would be targeted right away as an Afghan-American. His family cant leave and we cant get in so no time was spent with families just with each other.

Being together does not mean being together in his country or yours.  You can be together in Pakistan, for example.  Unfortunately, that is the only way that I have seen or read about for couples in your situation to successfully immigrate.

Sounds like the CO has serious doubts about the relationship.  The ONLY cure for that is to spend a lot of time together.  You might want to consider marrying, then living together outside the US.  Your K-1 is dead.  It will expire at USCIS.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

This is likely the issue in your case.  Spend more time together, as much as you can, document everything, get married, and then start the spousal visa process by including all of that evidence.  If you can't spend much time together, in person, you will have a difficult time convincing the immigration officers that your relationship is bona fide.  Some evidence of financial co-mingling, as much as you can get while living in different countries, would help immensely as well.  Many others in your situation have been successful with a spousal visa, but it takes time, work, and effort.  Patience will help as well.  Good luck!

You should actually be concerned on why it was sent back, as if you still want the visa, you’ll have to overcome those reasons.

 

Senator cannot help in this case.

our K1  denied in 2009 and understand why  u think u will hear from USICS but i never did

 

The 221 g he got at the interview tells u why the case was denied 

probably says "not eligible for a visa at this time"   which basically means u have not proven the relationship is bona fida by spending quality time toether

 

BTW your fiancee does know why denied from questions the CO asked

 

  1. marry and gather all evidence of time spent together and file CR1
  2. spend more time together
  3. copy all documents  u send to immigration and save them for reference for any RFE or later for any immigration process u may go thru 
  4. in your case it didn't go into AP for extended security checks for the Pakistan bene so expect a longr AP for CR1 
  5. get ready for a 2-3 year wait after u petition for spouse
  6. senator or rep has no power over immigration cases /what u get when u sign a form for Senator to look into a case is the same info u already know (case returned to USCIS)

Weren't you the OP that got meeting waiver, fast processing of K-1 and then immediate denial? I'm pretty sure people told you what to do.
