I never went through my K1 with the 90 days, but can I visit the US still?

Hi there,

 

Almost 6 years ago, my ex fiance and I were approved for the K1 visa in 2016. We were to get married in March 2017 but our relationship fell through and ended up splitting. I haven't been to the US since. I am planning on a trip to the US next year and I was wondering if I would still be admitted access there since I never went through with my visa. Was just wondering if it would affect my entry Any feedback is super appreciated! Thank you

Which applies:  your citizenship has a 

 

1. visa exemption (no esta required),

 

2. visa waiver (esta required), or

 

3. visa requirement

 

to visit the U.S.?

So I could still visit? I never got anything saying I wouldn't be allowed but I figured I'd ask here 😣

Need more info .. as asked before .. tell us your status regarding how you enter the US.. and if you still have a current unexpired ESTA or B1/2 visa in your passport. Its not an easy  or no answer to your question

Sorry for not being clear...after my ex and I split, we didn't do anything. We didn't let the government or anything know that we didn't go through, I wasn't sure if we had to or not, is it just dismissed? All I did was stay in Canada. We split before I would enter the US to get married within 90 days. Those visa papers are long gone now. I just looked at my passport, it doesn't expire until 2024 and it's completely blank, so I should be ok?

They're asking for your citizenship. Are you Canadian?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Thank you. The K1 would have just expired . Filing for a K1 but not entering should not be an issue for a Canadian .. i believe you do not need a visa for a land entry at least

As is always the case, entry  into USA will be at discretion of the CBP officer.  Since have previously expressed immigration intent you will have to show that your ties to Canada are stronger than your ties to the U.S.

As a Canadian citizen, you should be ok, it will be up to the CBP officer.  Just make sure you are completely honest when asked the purpose of your visit and how long you plan to stay.  A short trip of a few weeks for tourism would likely not be a problem.  Are you going to the US to visit a boyfriend/girlfriend?  How long do you plan to stay?
