Dear, First of all thank you a lot for taking the time to read my query.

 

My name is Mar, I have a PhD in Computer Science and currently doing an MBA Exchange Semester at Cornell University (F1 visa for a semester, not OTP eligible). 

 

I recently got an offer to join a consultancy firm (Mckinsey) as a Manager in New York with a starting date of February 2023. I have already worked in the consultancy profession for 8+yrs in Sweden before taking a study leave to come and study here. I am wondering what type of visa would be applicable in my situation, and is it realistic for me to start in February 2023?

 

1. If it is H1B, I read that the raffle is in March and starting date is in October every year. Would this mean that I have to wait unknowingly if I get selected in the raffle, and if I could even possibly start in October?

2. Are there any other visa that could be applicable to foreign nationals with a job and visa sponsorship offer from a US company?

 

I am waiting for the company to connect me with their immigration officer but I am worried as I am going back to my home country (Sweden) soon since my exchange semester is finishing. Thanks a lot for any insights. I really do appreciate it a lot! 🙏🏻

McKinsey's immigration attorney will know the answer to your question about the feasibility of the timeline for an H1B and whether a February 2023 start date is even possible.  Ask if they are willing to pay the extra $2,500 for premium processing which takes 2 weeks.  Also ask about the end date of your academic program, F-1 authorized stay, and when you have to depart and return home, as you don't want to accrue any overstay days.  Most likely you'll have to leave the US and continue to pursue this from Sweden.  It could take a long time.

Hi friends,

 

If I am employed by the same company abroad, for example BCG UK, and I have an offer from BCGUS. Is it allowed to apply for H1B lottery in this case? Or is L1 the only way I can start working in the US? Thank you!

do both if possible. if you get the H1B through lottery prefer that, it is just easier to switch employers on the H1B as any H1B transfer will be cap except whereas L1B is not portable and if you need to switch employers they will need to sponsor a new visa in a EB category generally H1.

The company may start the process towards getting you an H1B visa (eventually).  Note that some J1 visas may have a 2-year home country residency requirement upon completion of the J1 program.  If your J1 visa has that, it may delay your return to the US, even if you get H1B through the lottery.  Have you talked to the company's immigration lawyer yet about the H1B process?

Can you share how your experience ?

How long did it take for a decision?

Which documents did you submit to strengthen your case?

 

I have a PhD in Computer Science, publish papers, have held critical roles in an organization (in Europe), and have relatively high salary - which satisfies at least 3 out of 10 eligibility requirements (minimum). I am worried that this visa type is subjective and difficult to get. Appreciate any help! Thank you!

Does anyone have experience applying in EB2-NIW or O2 Visa? It appears that these visa type can be subjective as exceptional ability might be difficult to prove?

 

If I have a job offer from a respectable firm, would that help in any way?

I have a PhD in Computer Science but I do not have a lot of publications as I did not stay long in academe. I have 10yrs of consulting experience from large firms such Mckinsey, Deloitte, Accenture. 

 

Does anyone know the likelihood of this visa being granted?

Not sure I understand what would be in the National Interest of the US?

 

O2's are usually straightforward.
