Got Approvals for both 130 and 129F but unsure which will be forwarded to the NVC?

Hello all,

We finally got out approvals for both the 130 and 129F on the same day! Thanks be to God! :dance: So i'm really estatic that we can now move on to the next stage of the process to the NVC!! i can't stop pinchin myself to make sure its real!!..lol..

I wanted to get some clarity on what happens next. Do both of my applications get sent to the NVC together? or will USCIS (Vermont) retain the 130 and send the 129F instead?

Ideally i would like to go with the 130 ( for the CR1 visa) as that will take out the hassle of the additional paperwork for the AOS but will go with the 129F if that gets me to my husband quicker.Anyone know what is the trend for USCIS so far -sending both the 130/129F or do they retain the 130?

hopefully i will be changing my nick to 'finallyinME" soon!

Aug 24 Receive email from NVC confirming choice of agent

Aug 27 IV immigrant Visa fee bill generated - expect to receive in a few weeks.

Oct 31 Case completed! (Thank you Lord!)waiting to hear something in 8 weeks..

Nov 29 Received letter from Embassy re interview date

Dec 08 Medical

Dec 13 Interview - stayed up until 1pm the night before to ensure docs were in order. GREAT Embassy! :)

Dec 21 Picked up passport & visa

I129f

March 5 Submitted to MSC

April 5 Transferred to Vermont

April 9 Touch

April 23 Email about transfer to VT

April 26 Touched (hmm about same time as I130)

July 20 20.07.2007 We got our NOA2 for the I 129F!

Embassy

July 31 Received letter from Embassy confirming receipt of file & File number

The current policy is to hold the I-130 at the service center and proceed with the I-129F. For clarity, both are petitions, not "applications". Your spouse will submit a visa application, now that the petition is approved. If you wanted a CR1 visa, you should not have submitted the I-129F.

Facts are cheap...knowing how to use them is precious...

As pushbrk said, USCIS will hold the I130 and send the I129F to NVC according to recent trends. The new policy of sending them together will also further this end in the future, which indicates that this is what they intend to keep on doing.

Thank you everyone for the congratulations! :)

Pushbrk/Urge to race, we were some of the few that was caught in the DCF mess in the early part of the year and were unable to file for DCF as a result. Our intention was definately to file for the CR1 with DCF which would have given both the time advantage as well as the 'less paperwork advantage". However the change in DCF occurred and we had to weigh our next options.

The original I 130 process via the USCIS was supposed to take a lot longer than the 129F(k3) . Hence we decided to do both the petitions and see which gets to the USCIS finish line first. Right now, it seems that both are coming in as a tie - which possibly means 2 things 1) processing of 130's are now faster than previously OR 2) that the 129Fs are processing slower than previously.

I would still prefer the CR1 over the K3 anytime but NOT if it takes me 2 years to be with my husband. If the CR1 processing is 1 - 2months more than the K3, that is still tolerable and will still be preferred over the K3 visa.

Are you saying that i no longer have an option to go CR1? or that the CR1 process will still be a lot longer than the K3 and i should go with K3 instead?

I'm saying that if the USCIS follows their own procedures correctly, you effectively have no CR1 option. To get the I-130 moving again requires a $200 fee and months of waiting for the I-824 to be processed. We've only seen one get completed so far and it was several months. Others are still pending after more than 8 months. It's a waist of time and money, IMO.

I think the reason why people apply for both I-130 and I-129F is to have a choice and options later on. A lot of people where not aware of the "holding I-130" policy as it is not obviously stated anywhere. It would have been better to state this on the I-130 and I-129F forms so people know before filing.

Unfortunately, USCIS has taken the liberty to make our choice for us... K-3.

CR-1:

USCIS-CSC: 126 Days (2/1/07-6/6/07)

Submitted visa petition.

RFE for more evidence of marriage.

Approved petition, then mailed to…

NRC: 96 Days (6/7/07-9/11/07)

...wrong center! National Record Center (NRC) is a storage center.

I had to request them to send it to the correct center. Delayed 96 days!

NVC: 84 Days (9/12/07-12/5/07)

Received petition. Now I apply for the visa.

NVC approves visa application and sends it to Taiwan consulate.

AIT: 34 Days (12/6/07-1/9/07)

American Institute in Taiwan (AIT) receives visa application.

2 Interviews. Visa in hand!

Total Days: 340 Days

K-3:

USCIS-CSC: 126 Days (2/1/07-6/6/07)

NVC: 21 Days (6/7/07-6/27/07)

AIT: 106 Days (6/28/07-10/11/07)

Problem with fingerprint, wait 2 months.

CR-1 almost done so wait for that instead.

Abandoned K-3 for CR-1 on 1/2/08

Total Days: 253 Days

It was a change in policy last October. Changing the forms is an entirely different project. I agree that at least someplace you could reference the policy, should be avialable but I can't even find the bulletin that announced the change. Somebody better at searching might find it.
