Have found this website incredibly rich in information so far, as evidenced by the immediate DCF approval of the I-130 I filed on behalf of my wife. We were given Packet 3 straight away. I (the USC) am in the process of filling out the I-864 and am unsure of what the best way to present my situation is in order to make an RFE unlikely (not because I don't have evidence of my situation, only because we want to avoid delays. We've already been told that this can take 6 months.).

I am a self-employed photographer and artist, but while living abroad for the last 5 years my main income has come from a trust fund that amounts to 36,000 USD per year, ie more than what is required to support my household of 3 (we have a baby). I have filed tax returns every year, but I do not file a schedule C. The fund reports my income using a schedule K-1. I have filed 1099-Rs, schedule Ds and Es, but they have generally been related to investments and not my self-employment. If I have understood it correctly, what I have been making abroad is not very relevant because that income won't be sustained once I am back in the US and it is a modest income anyway. I have a few questions:

1) If I tick "self-employed", but my main income actually comes from the fund and not from the employment, will that likely generate an RFE or is the fact that I make more than the required 26,000 enough to be approved? (There is no other tick box that would be more appropriate, is there?)

2) Should I include any documentation related to the fund?

3) In addition to the above, my wife and I have some other assets and my wife is employed. Should I fill out the "assets" part or is this unnecessary given that the aforementioned 36,000 is over the required threshold?

4) The trust fund will expire in 2009, but we are not worried about this as I will be generating more income from my self-employment when I return to the US and my wife, if/when she gets her GC, will also be working. Will it be required that I somehow prove that I will in fact be generating other income?
