CR1.

Aside from the immediate benefits over the K1, some more things to consider:

- If the CR1 takes 2+years, then upside: spouse will get a 10 yr greencard.

- If the K1 takes 2+ years, you would still need to get married and then adjust status. If the AOS then takes 12-23 months, then your spouse will still have a 2 yr conditional greencard.  2 yrs later you will have to go through the removal of conditions, which may take another 18 months.

Total time from now (as soon as you can marry) to your spouse getting a 10 yr GC is 24 months to about 62 months (assuming 18 months for ROC) when doing CR1/IR1.

Total time from now to your future spouse getting a 10 yr GC is about 44 months (20 months for K1) to 82 months.

A great description, I would just like to clarify:

The post insinuates 20 months for a K1 to obtain a GC versus up to 82 months for a CR1.

Maybe I am missing something.

The last two paragraphs was a CR1 to K1 comparison.  24-62 months for a CR1/IR1 to get a 10 yr GC, vs 44-82 months for a K1 to get a 10 yr GC.

This is inhumane. 2 years to bring your spouse into the country. I think we’re getting off topic but I appreciate everyone’s feedback. I agree the cr1 is the better option for her but we are both concerned with getting her here initially. Does anyone have some verified data on these times because the agencies are saying 6-9 months?

With the USCIS stage alone taking 15 months for an I-129F approval I don’t see how that is possible.

2 years seems like forever. I agree, I am trying to find the best solution for both of us.

Every couple has their own priorities, and each couple must decide which visa is better for their situation.

K-1
    More expensive than CR-1
Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months)
Spouse can not work until she/he receives EAD (approx 6-8 months)
Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period
Spouse will not receive Green Card for many months after Adjustment of Status is filed.
A K-1 might be a better choice when 18-21 year old children are immigrating also
In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice
A denied K-1 is sent back to USCIS to expire

CR-1
    Less expensive than K-1
    No Adjustment of Status(I-485, I-131, I-765) required.
Spouse can immediately travel outside the US
Spouse is authorized to work immediately upon arrival.
Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US
Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It took me 3 years to get my wife and our 2 children here. Covid made it take an extra year.

The times have certainly changed.  MANY years ago it took us 6 months to get my fiance here from Russia.

Trying to figure out what option is faster..

k1

cr1 (read here it’s almost 2 years!)

open to any other thoughts or ideas.

thanks:)

Have a look at this page and the links.

I believe Juarez is really slow when it comes to CR1 visas... your partner might only be able to move over to the US after you hit the 2 year marriage mark.

Advice would be to either- move to Mexico after you file the petition and then move back to the US after the petition is approved.

OR move to a border city so you can visit your partner while you wait out the process.

You can also look into maybe getting married and moving to a third country where you can both obtain visas to live and work and go through a faster consulate.

Either way, after filing you will be waiting about 1-1.5 years before you leave USCIS/NVC so if living together as fast as possible is most important consider moving to Mexico or another country.

Here are K1 timelines out of Mexico:

Here are CR1/IR1 timelines out of Mexico:

So, K1 is appears to be faster but you are looking at a long wait either way...

She is from Durango. I’m looking at options for maybe staying there every other month trying to work remotely.

Which 'agencies'?  The only official source of data for petition processing is USCIS, and they say the I-120F takes 15.5 months currently.

Maybe you are looking at information from years ago.  When we did the K-1, the petition phase was only 6 months, but those days are long gone.

Agency websites and some lawyers seem very out of date, lots of websites that come up still quote 6-8 months.
Agree to only look at USCIS but newbies don't know that. Also reminder I-129F takes 15.5months to get notice, it's 2-3months+ after to actually get visa in hand.
