Hello,

we were told that filing for the k3 visa can speed up i130 approval. My husband petitioned for me and my child and we are at different service centers both with 1 year waits. If we file the k3 and it speeds up the i130 is there anything we can do to speed up my child’s? I can’t leave my child and would want us to be DQ and interviewed around the same time.

thank you

That trick might or might not work.

When the first I-130 reaches NVC, do NOT submit documents or fees until the second one arrives at NVC.  Then submit fees and documents for both and notify NVC and the consulate that you wish to have both interviewed together.

To obtain a K-4 visa for your spouse’s children, you do not need to file a separate Form I-129F or Form I-130. You must list your spouse’s children on the Form I-129F you filed for your spouse.”

K3 is dead.

Regardless, this is bad advice. Filing for K3/4 is important/worthwhile (in my opinion) for three reasons:

  1. It's free
  2. It actually *does* improve processing times if you end up at the right service center (I have evidence of that, including my own I-130 filing)
  3. Perhaps most importantly, it flags to the USCIS (and, I would hope, broader US Govt) that people aren't going to just roll over, and that they need to improve their system instead of creating workarounds (by not processing K3/4 filing and instead just speeding up the I-130 processing)
