There are a lot of variables and multiple tax filing strategies in LPR year #1.  One of the most important variables is the earned income amount for both spouses during the entire year. I always think it's a good idea to seek a competent, knowledgeable tax expert who will run the numbers for the various strategies in the first tax year.

Hi All,

I recently got approval of my IR1 visa and if I land around December 20th. Would I have to file taxes in USA for the year 2022?

I am a Canadian citizen moving to the US.

No, not if you didn’t earn income in the US between Dec 20 and Dec 31.
But it would likely save your spouse tax dollars by filing a joint return with you for 2022 to get the extra standard deduction of $12,950 so less taxable income. And the MFJ rate would be cheaper than her alternative of Married Filing Separately while you filed nothing.

I arrived in November 2021 and filed taxes in January 2022 for the 2021 calendar year.

I used this website, which was.free for federal taxes and cheap ($15-20?) for my state stuff:

https://www.freetaxusa.com/

I didn't owe any taxes as I only earned a small income as a US resident for about 6-8 weeks of 2021.
