questions about I-864

I don't meet the income requirement to sponsor my wife, but My father and brother both said they would help sponsor.  

My father is the main sponsor, but he is semi-retired so my brother will be a 2nd sponsor to make sure that the requirement is met.

 

Both of them are married and file joint tax returns with their wife. 

They both own homes, my fathers owns his house.
 

Wife has an ITIN, and I'm currently getting her a checking account with my bank in the US.  Ill be the main account holder and she will be secondary.
I have been filing my taxes as married filing jointly.  My wife is unemployed so her income is always 0. 

 

Here is what I know, or think I know.  please correct me if I'm wrong.

My brother and father would each file  I-864 and their spouse would file the I-864A.
They need to have an official appraisal of there homes within 1 the last year if they want to include it for part 7.

 


Here is what I want to know.

would it help to attach photocopies or transcripts of the tax returns?  (part 6, 23.b.)

would it help if they included their assets in part 7, even if they have enough income?

Does my wife need to file a I8-64 since she is on my taxes as filing joint tax returns?

If no one in the sponsor's household can help boost the sponsor's income and assets, you can look for a joint sponsor outside the household. Each sponsor needs to meet the basic sponsorship requirements. An independent joint sponsor must also be pretty well off financially.

Unlike household joint sponsors, joint sponsors who live outside the household will need to earn enough to cover the entire Poverty Guidelines minimum requirement for their own household and for the incoming immigrant or immigrants (if children will also be coming). The joint sponsor cannot simply make up the main sponsor's shortfall. It is as though they were the sole sponsor.

In fact, they must sign a separate Form I-864 Affidavit of Support. Like the household joint sponsor, an independent sponsor can be held 100% responsible for supporting the immigrant.

If there is more than one incoming immigrant, there can be up to two joint sponsors. This can be helpful, for example, where the incoming immigrants include an adult and two children, and neither of the joint sponsors earn enough to meet the minimum Poverty Guidelines for all three immigrants. As long as one of these joint sponsors earns enough to meet the Poverty Guidelines minimum for one immigrant, and the other joint sponsor earns enough to meet the Poverty Guidelines minimum for the other two immigrants, the I-864 requirements are met."

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You don't need both your brother and dad. Choose 1. Make life simple. 

 

Since all file jointly, there will be 2 I-864 as well as 2 I-864A. 

 

If you do both dad and brother, the above becomes 3 each. More paperwork, which you should try avoiding. 

 

You need IRS transcripts. Download them easily from the website. If you send 1040, it'll be 1040 + paystubs, which is more papers. Take easy way out.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Do you know which IRS transcript would work best?  I looked and i see "return transcript", "record of account transcript", "Account Transcript", and "wage & Income Transcript".

When you log in, it asks you what you need it for. Immigration is one of the choices. Select that and it'll take you where you need to be

I.  You can only have one joint sponsor.  Chose dad or brother.  YOU are the primary sponsor no matter what your income is, even if it is zero.  The joint sponsor files their I864 and their spouse the I864a no matter whether they have any income or not.

 

Be sure to become an A-Student of the actual I864 instructions, including but not limited to the part about the supporting documentation needed for the Joint sponsor and their spouse.  Sounds like the asset section can simply be left blank.  If Dad is retired, chose brother.
