Hey I’m the main petitioner and i did not meet the poverty guidelines for two people (me and spouse) i was suggested to use my brother as sponsor for my husband
He is the household member and he listed our parents in his Federal income tax return
I’m the main petitioner (his sister not listed as dependent for him in his
Federal
income tax return)and she is doing her tax every year independently
the question now my i am living with them in same house so total of four people and I’m related to the household member (my brother) but I’m not listed in his Federal tax return (just our parents )
the Question what is the right form to use for my brother as joint sponsor (form 1-864) or household (form i-864A) in this case

Ps my brother files his taxes as head of household

I-864.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Your household is just you and your spouse.  You are NOT included in your brother's household. Instructions are clear on that.

Your brother's household is him, his listed dependents and your spouse.  He is the joint sponsor filing an I-864 in addition to yours.  If he's married, filing a joint tax return, his wife should provide an I-864a as his household member, regardless of her income and even if it is zero.
