Travel while adjusting status

Hi everyone!

I've received some conflicting answers from other sources, so I'm hoping this community can settle it for me.

 

I currently have an L1-B visa which was just renewed until February 2024. I am in compliance with the requirements of this visa (same employer, same job, etc.).

 

I also recently got married to a US citizen and plan to adjust status soon. We haven't yet filed the paperwork for this, but I will be applying for Advance Parole and the EAD.

 

2 questions:

1. Am I still able to travel with my L1 visa while adjusting status?

2. Would travelling with my L1 AFTER filing the I-485/I-130 but BEFORE receiving the Advance Parole/EAD hinder the process at all?

 

I would like to file to adjust status ASAP but have unmissable travel plans coming up, and would like to travel home to see family before submitting the I-485/I-130. I'd basically just like to know if I'm causing trouble for myself if I file I-130/I-485 now, instead of after returning from travel.

Go ahead and file your I-485 package (with I-765/I-131) ASAP.  You may come and go as you please using your L1, as long as it is valid or until you get your green card.  If/when you get EAD/AP, do not use it, except as backup, in case your current employment ends while your I-485 is pending.  Until you get your GC, continue using your L1 visa for re-entry into the US, so you retain your L1 status.
