he says he married within 90 days

issue would be forms USCIS uses and letters sent out are genertic and apply for different catrgories

he needs to follow the steps for K1 AOS  and not AOS for tourist or student

it does get confusing ,,  yes,  but to Hanijai,   please do a timeline on your portal

if this V J community knows when u arrived and when u married here in US,  they can answer your original question without digging u with more questions so they can help

timelines help / we look at them and then know what we need to know to answer with complete information for u

to be more specific i comes the October 6th 2021 and i married December 16th 2021...  witch mean i married after 70 days of being in usa

And you’re just now filing for a green card, after being out of status for one year?   Dude…

my wife filled forn I-130 and i filled form I-485 and we send them together

That was incorrect.   That was not in the instructions on adjusting status from a K1.

You are out of status, and subject to deportation.

Marrying does not grant you immigration benefits… applying with appropriate forms does. You have been out of status once your I-94 expired since you have not applied for I-485 in a timely manner…. Just marrying is not enough

You can still apply but this whole time you were/are under a big risk and could have been detained. You need to apply NOW

that`s what I'm trying to do . thank you so much for all the info you provided to me today i appreciate it

Good luck. Study the guide and ask questions that come up, we’re happy to help

I would assemble a new packet consisting of I-485, I-765, I-131, I-864 forms and submit all of that together as a new submission instead of re-applying under the rejected packet you received back.

You are out of status.   You have no legal status to be in the United States, and you will not have that until a properly filed I-485 has been accepted.   You need to try to educate yourselves a bit more on this process.   Perhaps your USC spouse could become more involved?

I think this is the point of me being in this website so people that know or have better experience could help me and other that need help. And like I said any help would be appreciated. But it seems you are very agressive when you answer.

Just because they are telling it as it is, it doesn’t mean they’re aggressive. The truth is the truth: until you submit your forms and are accepted for processing, you are out of status and subject to deportation. Before they told you this, you thought that you were in status just by being married to a USC. Nothing further from the truth.
It seems you’re doing this without a lawyer, which is perfectly fine (I myself and thousands of others here have done it that way), but that’s something you can do only if you are an A+ student in the forms you need to fill and in the process you’re about to engage in. This is a huge undertake for which you need to be ready with the proper information.
And your USC spouse should be equally invested.

Totally agree. Normally my wife was in charge for almost everything. just after they rejected the file I start doing some searching about it and a friend of me recommended this website. And yes people in here provide a lot of important information that we really didn’t know about it.

like I said I’m here just to learn and show my wife everything being told by you guys. I’m trying to do my best as she is.
