This is the last time I will be saying this - I-130 is not to be filed if one is adjusting status form k1 and if you married within 90 days.

please read the Guide that I posted earlier.

I don’t understand why you apprehensive about what we are telling you. I have gone through AOS form K1 myself and received my GC this past February if this helps.

i appreciate everything you guys told me of course i keep looking at all answers that`s help me understand things. and of course thank you so much

i hope u applied for SS # with the 1st part of your 90 days (do'n't know the cutoff time but others do)

if not,  u will need to mark the box on form for USCIS to apply for your SS #

remember u are married and the USC needs to say married when filing 2022 tax returns /  this is important for years to come when u ROC and later naturalize

she can still say married even if u do not have that SS #

If you entered via a K-1, and if you married within 90 days, you do not need to file an I-130.

Please read, study, and follow this step-by-step guide:

You are out of status.  Once you file a proper I-485, you will be granted authorized stay in the US until the I-485 is approved or denied.

Looks like you're out of status? You should have married and sent AOS packet within 90 days of entering the country on K1 visa... Did you at least marry within 90 days of entering the US on K1?

he says he married within 90 days

issue would be forms USCIS uses and letters sent out are genertic and apply for different catrgories

he needs to follow the steps for K1 AOS  and not AOS for tourist or student

it does get confusing ,,  yes,  but to Hanijai,   please do a timeline on your portal

if this V J community knows when u arrived and when u married here in US,  they can answer your original question without digging u with more questions so they can help

timelines help / we look at them and then know what we need to know to answer with complete information for u
