Hi

 

Me and my wife sent i-130 and i-485 to USCIS in Texas. when we are living just 1 hour from chicago.

the USCIS in Texas rejected our both forms i-130 and i-485 saying

 

The payment amount is incorrect, or has not been provided. Please review the form Instructions for fee information.

Please resubmit the application/petition package with the appropriate fees to the address listed on the bottom of this page.

 

Based on the information you provided, your priority date could not be established. please resubmit your application with the proper documentation to the address listed on the bottom of this notice.

 

The following documents may be provided:

*your original Form I-130

*your original form I-140

*your original Form I-360

*A copy of your Form I-797,(Notice of Action) if the I-130, I-140, I-360, or I-526 petition has already been filed/approved; or

*Other evidence that an immigration visa petition has been filed/approved or your behalf.

 

--- I think we should not combine the amount in one check but we will fix this.

--- can i sent it to Chicago instead of sending it again to texas ?

I-130 is not to be filed for K1s. It’s I-485 only along with concurrently filed I-765 and I-131 (both free). The fee for that would be $1,225. You got lucky they rejected it, they might as well have taken the money for I-130 and you’d be out of $535.

 

Looks like they’re asking for a copy of NOA2 for I-129f. It should have been included as well.

but they will not work on I-485 if they did not approve I-130.

and we sent them just $1225 we did not notice that I-130 need $535 that also reason of them rejecting it

On what basis did you file I-130?  From what status is the immigrant adjusting?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Your wife is adjusting from k1. You do not file I-130 if you are adjusting from K1. You file I-130 if you’re adjusting form tourist, work or student visas to establish relationship to the petitioner

i comes to US With K-1 visa now that we married i need to fille for adjustment of status witch they ask for the I-130 and I-485 so i can get my Green card and SSN

Did you marry within 90 days of arriving in the US via the K-1?

There seems to be a lack of research done about the process. Once again, you do not file I-130 for K1 if you married within 90 days.

my wife filled forn I-130 and i filled form I-485 and we send them together
