I work in jails and prisons, when my wife was interviewed for her N-400, she was asked, if she ever been to jail. She sayed yes, we work sometimes in jail, as outside contractors. The interviewer  told her, good thing you were honest, when you show your driver's license, as an ID to enter jail, I have this record. Talking about keeping records. FBI keeps records of arrest for ever. last I heard they were working on arrest records from 50 years ago. I am talking about an arrest, even if you were found innocent. The best way to find out, is to apply for a concealed carry permit.

Definitely gotta be honest!!
I’m not sure why but somehow people always assume that you’ve been arrested if you’ve ever had an indictment but I was never arrested, ever, for anything.

Yes, you must disclose . Make sure you carry the certified court disposition records with you . It will not have a negative effect on you .

A nolle prosequi disposition must be disclosed on all immigration and visa applications even though it isn’t a conviction

Do I wait to be asked about it or do I bring it up myself at the interview?

You bring it by stating you need to update/correct the DS-260 answer for item  # xyz., and provide court records.

You should upload to CEAC  a short Letter titled request to Update DS-260 , say it was an unintentional error and also upload court documents BEFORE the interview ..

This is post COVID-19 protocol as they want everything brought in person to be uploaded..

Personally, I'd bring it up now since you have all the documentations rather than kick the can down the road to the N400 interview and then be asked why you hadn't said anything at the beginning of your immigration journey.

Lover and hubby to 1, Daddy to 2. I do enjoy growing older but not growing up.

A filthy, dirty oilfield engineer.

N400 through marriage to another filthy dirty oilfield engineer.
