Unfortunately you have 90 days to get new originals of your son’s birth certificate, any divorce/custody court records ( or attorney opinion and statute) for  the legal custody and the list of items to show physical custody .

 

It would make your life easier if you had kept copies of everything….

 

If you run into delays and get close to deadline for responding, send them a Request to Extend Time due to circumstances beyond your control ( delay by foreign country courts..example)

I have copies but I sent them the originals which they are requesting. Should I send copies of everything?

Unfortunately the RFE does NOT acknowledge they received originals of the items listed, so you need to obtain new originals. 
At most , if you can’t get them within 90 days and must ask for Extension, you can provide copies of documents and state they were lost at filing. 
 

At issue is 

1. Birth certificate ( just get a new original)

2. Legal custody . What exactly did you have to prove this?  We’re you married to other parent ? 
3. Physical custody is easy ( passport stamp at entry w I-551 , school records, medical records, health insurance, a couple of family friends affidavits that he lives w you, copy of lease or letter from landlord

Then at least make an effort NOW, before the 90 days pass and respond with ALL the copies you submitted. Argue that each of the items requested ( if you are sure ) were filed as originals , they are impossible to obtain again in a timely manner and point out the Passport Agency has either LOST the originals or RFE was issued in error.

 

Your son will face the same issues down the road …so at least give your best shot. 
But am still not clear what originals you say cannot be replaced…
