I am sorry you are having to deal with a situation like this and take care of a newborn.  I am curious, if this was something he has been planning are you certain he did not actually get the spousal visa and re-enter with it and not tell you?  I am not sure how you would know other than getting in touch with the consulate in Pakistan.

Yes, Pakistani men are known to kidnap children internationally. As are men from my country, so I know a little about it. Sometimes they do it through other Pakistani men and even women. They kidnap the child from daycare and send her back home to be raised by her aunts, while he continues living his life here. Many such stories. Be careful and take precautions.

Posted (edited)

Oh, really, he could possibly kidnap her? Yes, that is what concerns me. I feel like he is plotting to do something really dirty. Somebody asked had he planned this all along. I would say he was using me for benefits and after he found out somebody else could offer him more, he fled from the scene to be with them instead. I feel like he eventually would have left me for somebody else no matter what and that he never loved me. He started calling me really degrading names over the past few months. He had booked a flight back in July for another city in the same state of his POE. So, I can only assume he was planning to be with whomever he is with for a long time. He told his mother he was coming here to earn money and that he would not live with me. On the website for department of state it says updated October 11 and it says "ready". Would it say "issued" if he got the visa? His family lies so much that I cannot separate the lies from the truth. I asked his brother where he was when I knew the truth and he said, "he is in his room in bed". Yes, I can only assume he was in bed with somebody aside from me here in the USA. I have not been able to eat in 4 days and this entire betrayal has changed my entire idea about him and his family.

Did he have his interview? Did he do medical exam ? . Did you upload financial updates to CEAC for the Spouse Visa DS-260 case?

How do you know he applied for a B1/B2 visitor visa ? Did you “see” a DS-160 or help him schedule an interview?

Sounds like he and his family have been spinning lies …and the  Consular Expedite for the spousal visa was also approved..and there was never a visitor visa .????

Only way you can verify is if Embassy responds and verifies they gave him the IR-1

Even better than ICE might be the FDNS officer at your local USCIS office.  It's optimal to hand over your letter and data in person, if feasible.

It's important that you eat, for the sake of your baby.  Yes, this all sucks; however, from your posts here, we can all see that you're incredibly strong (admirably so!) and that your head is screwed on very straight.  Eat this elephant a bite at a time, and it will clear the path toward an improved life.  As necessary, repeat aloud to yourself, with increasing conviction:  "This too shall pass."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The status says Ready online at the US Embassy. He is from Pakistan. He had a scheduled interview but was here on an emergency tourist visa. Then he later went back during my pregnancy (early on). He decided to re-enter on the same tourist visa so he can work here under the table. He does not have work authorization on the B2 visa. I just found out this week that he was here two days before my baby was born by scheduled cesarean section. So, he entered pretending to be coming to me and then he went off to another state with another woman. I do not think it is really fair to me that I gave him 6 years of my life and then he had been cheating on me the entire time with this lady. I think his sole intent to marry me was to enter into the USA.

As you mentioned the interview was already scheduled which means that the case must be with U.S embassy in Pakistan. Please use this form https://pk.usembassy.gov/visas/immigrant-visa-inquiries/ to directly contact them and explain your situation and ask to withdraw the case.

I emailed the Senator, and they told the USCIS that I intend to withdraw. I did this prior to his entry, and he rushed here on the visa. I think he has no intent to return to his country

I believe only contacting Senator is risky as they should have notified U.S Embassy or NVC directly instead of just USCIS. I would recommend contacting Pakistani Immigration Unit as fast as possible. They are the ones that need to return the case to USCIS which will terminate the case.

Hopefully you haven’t listed him on the birth certificate.

Withdraw I-130 and I-864, then scan that letter and email Islamabad IV unit.

I would have no qualms flagging to the embassy  non-immigrant visa unit that he was fired for abusing kids in mosque - we certainly don’t want the same thing happening in a mosque in the US.

I was with him when he was issued the emergency travel visa as he got it because of me losing a baby while I was there with him and needed to travel back here for possible medical care. His I-94 states B2 as the entry visa and that is the best I can find out and he is able to stay 6 months and it is goof for 5 years (4 more remaining.

What happens if he is on the birth certificate?

Great . That means he definitely will NOT get a green through you. Just get your signed statement emailed to Islamabad Embassy and they will do the rest.

Don’t worry about his name on birth certificate…just get your strength and follow through with divorce ( annulment if possible) and Sole Legal and Physical Custody of your baby….he did  abandon both his marriage and his child and straight out lied to the Consulate when he obtained the emergency visitor visa..

Yes, and today I received a little more information needed to report. It burns me up that he entered this country and did not have the decency to be a real man and attend the birth of his child. I can only hope someday he will be held accountable for his wrongdoings. But for now, I have to focus on the important things and that is making sure he does not get a green card with my help. I wish I could get his location. All of his numbers, emails, and forms of social media he has not attended to since entering this country.

It burns us up, too, honestly.  Your feelings are very valid.

If not in this world, in the next.

Avoid worrying about what's out of your control; send what you have.
