Pending i130s… are there any other options available? (merged)

While it is possible for your husband to push ahead to get his visa before the children, it is not possible for him to go to the USA before you do.  That's why nobody is advising you in that direction.  It would mean YOU leaving the children behind.

Thanks for your response. I appreciate what youre saying and just to confirm there would never be a scenario where we left the kids! No matter how annoying they can be! :) 

 

I see the benefit of my husband pressing ahead with his visa application if his i130 were to be approved before my children because he could start job hunting for employment in the USA whilst in the UK whilst and my children wait for theirs? Anyway, we're a long way off that but appreciate we should prepare ourselves for the next steps :)

This is a family reunification visa, as has been mentioned you need to enter before or with him.

Just to be clear we will be entering the USA as a family of 5, no doubt about that! 

 

what I’m saying is, when my husband is granted his visa, we’ll still be in the UK still, so can he look for employment in the USA from the Uk, whilst we wait for our kids to receive theirs? And just pushed back the employment start date? Or does he not officially get his green card until we set foot in tbe states? Obviously the best outcome would be that the kids visas could be expedited if my husbands is first

US does not care what he does in the US, depending on his work area potential employers might.

One thing to keep in mind the fact that his visa will expire 6 months after his medical exam....As I stated earlier, you might to hold his case at NVC until the children's cases catch up.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Ah I see, I didn’t realise there was an expiry date! ok makes sense to wait for kids to be approved!

Yep.  All immigrant visas expire no later than 6 months after the medical exam (not after issue)....sometimes sooner than 6 months.

The problem with what you are thinking is that the visa has an expiration date six months from the medical.  Pressing ahead means you'll have no way of knowing whether the children will get their visas before that time.  So, what will you do if his visa expires before they have theirs?  Yes, that could happen.  Chances are that if you filed all the petitions at the same time, they will be approved at the same time anyway.  Why do you think otherwise?

Husband can start looking for jobs probably around the time the petition is approved. He'll get a stamp in his passport when he enters the US that serves as a temporary greencard till the plastic card arrives so he would be able to work right away ( He'll still need a SSN to get paid but it's not holding him back from job hunting ). Another option could be ( in case the kids visas might take longer ) that you enter the US together with your husband, he stays and you go back to wait it out with the kids.
