he returned 6 weeks later and they married in the UK, they both returned to the US 1 week later where they have been living ever since.

That’s not possible with a K1. It took at least a year to process form start to finish in 2021, not 1 week. What he did was adjustment of status in the US (I believe fraudulently as they did have an intent to immigrate and used ESTA (tourist) to achieve that). This whole thing does not involve a K1 and no, there are no loopholes.

Don’t believe everything you see on social media. They said they used K1 to come because everyone knows of “90 day fiancé” and thus, it will attract more attention.

Appreciate that, I think my confusion/ frustration comes from them being very open about it with no consequence. Not that I’d like to see any couple kept apart - it just seems unfair that even if they did enter fraudulently there don’t appear to be any consequences. C’est la vie!

There is a couple on social media who met in the UK for the first time in September 2021, he returned 6 weeks later and they married in the UK, they both returned to the US 1 week later where they have been living ever since. They’re very open about their timeline on instagram, TikTok etc and have hundreds of thousands of followers, the British citizens son also moved over. They post multiple photos videos etc of their marriage and repeatedly say they used the K1 visa. Does anyone know how this is possible given most advice on this thread advises against even an engagement party. I’m not doubting the advice - I’d just love to know if there is some loophole I’m not aware of!!

This is not possible for several reasons.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I agree with you (I was a K1 myself). I don’t think AOS should be allowed from tourist visas/ESTA/VWP.

Agree.  In general, that law needs to be changed, imo.

When you say they are open about their timeline, what do you mean by that?  Was the K1 visa issued prior to their marriage?  I have heard of a few stories where a K1 was issued, then the couple married legally prior to the entry to the US.  That should not be possible, but it is a bit of a grey area since the Department of State already issued the K1, and the Department of Homeland Security handles US entries.  If they are in the process of adjusting status, then it may become an issue, it is hard to say.

Sorry I should have clarified, they’re very open and specific about when they met online (Sept 2020) what date they met in person in the UK for the first time (Sept 2021), when they married in the UK (Nov 2021) and when her and her son moved to the US (1 week after their UK wedding, Nov 2021). *They say* when asked they used the K1 visa. Clearly that’s not true, but these videos are in the public domain, she has almost 400k followers and over 10m views on her video, she makes no secret about it so originally I thought “they must know something I don’t know”. But maybe it’s plainly, they’re more brazen than I am!

They're not being truthful about whatever process they've gone through.

Getting married to a foreigner in the UK involves a certain visa process (you can't just arrive and get married).

But, I've seen several international couples not be totally truthful about their circumstances and create a narrative that others can't replicate.

They might have filed a marriage visa for the UK.

They might have just had a unofficial ceremony in the UK and then moved to the US together while waiting out the K1 or the CR1 visa in the UK...

People don't know the truth about the process so they're not being brazen about fraud but really giving others an unrealistic idea of the process for likes.

She has a small business selling clothing now and talks about starting a job in a school “when the AOS is complete”. She also earns money at the moment via social media but I’m not sure that could be classed as a ‘job’. She has reported multiple times that her AOS is nearly done and she’ll be able to return to visit the UK early in 2023.

Apart from the marriage in the UK, it sounds like she may have entered the US via ESTA/VWP and are now adjusting status.
