Hello all.

 

My nephew ll start his CR1 application and i ll appreciate so much if you can direct me to the process.

 

He ll marry in dec to us citizen. He overstay his turist visa by less the 360 days and after marriage they ll start to file his GC.

 

1. he has to file the i130 with the i485?... and when he has to file the 601a? ( he ll be 360 days in january so we dont want file over that time bcs the 3 to 10 yr bar)

 

2. what are the first steps?

 

3. Do you think is better to file it himself or is necesary a lawyer?. ( i know i130 myself bcs i did it for me n now i m citizen, but not sure if it ll be so complicated that we may need a lawyer for the waiver part. i also believe some lawyers are not all over cases n its the reason i wanna help him to keep sure he files all at time n good.

Is your nephew in US or outside?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

he is in usa from jan 16 2022. and he ll not leave. Thx

yes he is in B2 visa overstay and now ll marry in dec 17 and planning to adjust status. but bcs the overstay b2 i understand he ll have to file i130. i485 and when approve then i601a?

Does not need I 601a when spouse is a USC and entered with inspection

You always have to confirm..terminology is an interchanged here

Yep, it’s amazing how easy it is to adjust status with an overstay! Many, many, many people do..
