Parent Evidence I-130

Hi,

My wife just became a U.S. Citizen, we are waiting to the Oath Ceremony.

I want to be ready for this when the time comes (we plan to apply for her parents ASAP when she gets her naturalization certificate) - both her mom and dad.

Is there a thread to show the evidence/documents needed to apply (a nice full guide) for parents? If not, what evidence do we need to submit with the I-130?

I remember when I did the I-130 for my wife (filing as a U.S. Citizen for my spouse for CR-1) I had to submit LOTS of evidence (phone call records, pictures, marriage certificate, etc.)

she is not a citizen till she takes the oath

This is very important. On the off chance that she (or you) officially states somewhere that she is a citizen, registers to vote, etc., this could cost her her citizenship altogether as it would be misrepresentation

I hope her oath gets scheduled soon, and I really hope your field office or court house allows family members and friends to attend.

Immigration for parents will entail less evidence than for a spouse as you don’t have to prove a bona fide relationship or marriage. You do have to prove familial relationships though, which you do by submitting birth certificates, marriage certificates of her parents, etc.

thank you so much! Her oath just got scheduled for 2 weeks later. Yes I’m aware to not claim citizenship or vote until it’s done.

but here’s my question … petition for parents SEEMS SO EASY!!!!!! Is it really the case???

for example, for my MIL all you need is my wife’s naturalization certificate, and my wife’s birth certificate listing her moms name?? (And obv her moms passport)???

also I remember I did a financial support (AOS package) when I brought my wife.

is there still a financial requirement? Is it done during the NVC step?

For mom's petition, your wife turns in her birth certificate to show her relationship to her mom.

For dad's petition, aside from her birth certificate, also has to include her parents' marriage certificate to show their relationship.

Both petitions will also need proof of your wife’s citizenship.

Yes, down the road - once at the NVC stage, they will need affidavits of support.

Just to make sure - at NVC with the AOS package neither myself nor my wife HAVE to be the financial sponsor right?

Because my brother plans to do the I-864/be their sponsor.

Also the I-130 can now be done online from what I read. Is that the case? Any recommendations on if I should file paper or electronically?

and do we send the originals or copies?

I am not quite at the NVC stage yet - but I know in my case I will file the I-864 and my husband the I-864A.

Perhaps someone can chime in and clarify that part for you.

I filed and paid for my Mom's petition online. I find it much easier and am able to upload additional documents instead of dealing with the hassle of mailing. Only copies are needed.

The petitioner is ALWAYS the primary sponsor.  Even if the income does not qualify.

In this case, the petitioner is your wife.

Your brother can be a joint sponsor to meet the income requirements.
