Hello, My spouse recently got his IR1 visa from the embassy. Can I who is the petitioner and US Citizen spouse travel with my husband to the USA?

Timeline

When you both  land in the USA, you will both be pressured by airport employees to

 

* use the kiosks. Refuse. If the beneficiary uses a kiosk the immigration visa won’t be properly endorsed.  

* go in separate lines.  Refuse.  As noted by @powerpuff you must enter the USA together. 

 

In general you  both  need to approach passport control together in the visitor line.  
 

There will be people chiming in that  they were able to go together in the citizen line.  That’s wonderful for them but that is not universal  practice  across all airports and all CBPOs. A CBPO in the citizen line might not be trained on processing an IR-1.  Or might not have a working finger print reader.    So unless you want to get barked at by CBP, comply.

In IAH airport (Houston, TX), we were asked to line at US Citizen together.  At immigration, the officer explained that a next level will need to process for my husband (beneficiary).  So, I was processed, then an escort lead him to another counter (same area that was empty, and another officer came in), and I waited at exit (before heading down).  All was good, he was not questioned, just a stamp for CR-1.  He met me at Exit and we both exit out (escalator) the immigration floor.

At SFO we were asked the same and I refused.

Whereas in the visitor line at SFO the CBPO who processed us knew exactly what to do with a K-1 visa, and stamped my fiancée’s visa right there. Then he then sent us to baggage claim without a secondary. We stayed together the entire time.

In my experience, the CBP agents here are highly knowledgeable of all visa types.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Oh wow, thanks for the warning. That’s really important. What should one say if they’re being pressured to use the kiosks?

Thank you but I am immigrating. The Consulate told me to use the visitor line

Is the process any different if my husband and stepchildren would be traveling with me in my car across the border?

 

I live on the Texas side, and they live on the Mexico side, so it would make the most sense for us to travel in the vehicle. Does that make a difference? Would there be any advantage to walking?

 

(We are still a long way off from that day, but I like to picture what will happen when that day finally comes :) )

I would park on the U.S. side,

walk into Mexico,

pickup the family and walk into the U.S. as a group.  The new immigrants will likely have to leave the car and given the volume of vehicle traffic at the U.S. / Mexico border, finding a place to park the car at the check point could be a challenge.

Good point. Thanks for the advice!

 

I've also read that the immigrant needs to have enough luggage that it's obvious they're moving. Is that true? Would one or two suitcases per family member be considered sufficient?
