Hi all,

We have an infopass appointment next week to hopefully get my 2 yr green card replaced with a 10 yr one. I will also be notifying the USCIS my new address. We never actually gave an address at my interview just the name of the military base where my husband is stationed. We were given base housing at the start of this month so now we have a physical address. What will haappen at our appointment when they realise it has been more than 10 days since we moved into our new home?

Thanks!!

11-05-06 Sent I-130 to California

06-01-07 INTERVIEW

06-04-07 Received VISA in the mail. Silly Consulate issued me CR-1 instead of IR-1, no time to change it in Australia, will try to change it once in California.

06-10-07 POE SFO

06-21-07 Receive SSN#

07-12-07 Receive Green Card in the mail STILL HAD CR1 INSTEAD OF IR1

12-10-07 Finally sent I-90 asking for a new green card with correct info.

06-17-08 INFOPASS - Was told USCIS sent new green card to old address back in Jan. Will resend it but may not be able to correct error as it was made by Consulate not USCIS.

What to do now??

did you send in your I-751 form to remove the conditions on your 2 year card??

I am not sure if you know but you can't just go to an info pass appointment and exchange cards.. you have to send in the I-751 form along with evidence of a bona fide marriage...

http://www.uscis.gov/files/form/I-751.pdf

for the change of address you need to file some forms.. the AR-11 and the I-865...

the AR-11 you can either file online or mail in the form... Online change of Address

http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

the I-865 you have to mail in...

hi marilyn

hollywood was given the incorrect visa at sydney embassey.. she is eleigible for a 10 year green card but they issued her with a IR visa type instead of the CR1 (i think i go that right)...

this is why she is trying to get the 10 year greencard mate because of sydney consulate stupid mistake after she was told at her interview she will be receiving a 10 year greencard..

if you have time hollywood do the online address change mate before your info pass..if not take all the necessary details with you about the address change....

good luck to you mate

Thanks,

However, I am not adjusting status. I was never meant to be a Conditional Resident. The consulate made a mistake issuing me a CR-1 visa instead of an IR-1 (10 yr green card). We are just going to correct this mistake and inform them of my new address.

What will happen seeing as we are informing them more than 10 days later? I read on the appropriate form that there is fine. How much is this? And what other consequences are there?

Hi again,

We did show our marriage certificate in San Fran, the officer didn't want to look at it and said we had to contact USCIS. This same airport did this to another girl who was also given CR-1 instead of IR-1. Not a helpful airport for people in this situation!!

Thanks Kath,

I hope you are feeling better after your vacation!

After this mess is cleared up I will be looking into how to lodge a formal complaint against the Sydney Consulate and the Immigration Officer and or CBP. Also considering getting legal advice on how to get Sydney to reimburse our costs for fixing their mistakes! Probably can't do much but I do want an apology which they have avoided. And I also want them to realise that some employees are not doing their jobs correctly and perhaps they will not hurt future Aussie applicants!!
