Hi everyone,

 

So long story short, came into the US under K1 in Dec 2021, got married and then filed for I-485, biometrics was on 6th April but so far I’ve heard nothing. 
 

I was suppose to go to my country for a Chinese wedding celebration on Dec, but now we have postponed it to end of Jan/Feb because I have not been approved yet (my I-485, EAD, and travel all together). 
 

Furthermore, I’m now even worried because I found out I was pregnant last week (apparently I’m 3 weeks in), and I wanted to see my family asap before I get too large to travel, and then not being able to see them for another 2 years potentially…

 

I’m kind of stressed because I really need to see my family abroad before I become too “big” to travel 😕

 

Should I request for an expedite?

if I manage to be approved by end of the year then it’s all good. But if I travel around feb then I’ll be 2-3 months in which is still ok. I just don’t want to get to 6 months and then I won’t be able to travel. 
 

(ps - for those who think eg I could have not gotten pregnant yet if I wanted to travel , it’s not the case as I’m in my mid-thirties so we were trying.)

You can try expediting, but 99% chance it won't work. Unfortunately, pregnancy is not a reason they would expedite your case.

 

It would be great if they approved your case by the end of the year, but I don't think this is going to happen. AOS takes a while nowadays, for example in San Francisco it takes 28 months, or it takes close to 17 months in New York.

 

If you leave without your I-131 approved, you would abandon your Green Card application. Likely, you would not be allowed into the US.

 

Sorry for bad news, but there's a big chance you have to wait a long time and won't be able to see your family before giving birth.

Did you apply for AP?

 

I a big proponent of seeking an expedite but you need a valid reason.

I think OldUser is right, the wait times for an interview are very long right now, and I doubt pregnancy will be considered to expedite.


Saying that, I applied for AOS Dec 2021 in NYC, it was saying 18 months and I was very lucky to get my interview within 7 months and received permanent resident card a week after. So I hope your case gets lucky too. If not, hopefully you applied for AP and that gets approved soon!

Worrying about pregnancy and travel is definitely not a reason to expedite.  The travel and work issues are a well known drawback to the K-1.  Hopefully you will get AP shortly.

I did apply for AP but I did not write that I was going to leave soon because at that time of submitting, Malaysia was undergoing (still) and intense lockdown so I didn’t know when restrictions would have been lifted. 
 

It was one of the last countries to open - actually only around Q2 this year. 
 

i would amend AP if I could but I don’t think I can now!

No big deal, my mum can always travel over :)

 

just wanted to check anyway. Not planning to leave without I-131 as there is no emergency.

will be on the lookout. It is 7 months currently since I submitted applied in March/April-ish.
