Case reaffirmed after denial but daughter started university

Hello my I 140 was approved by USCIS then denied at consular interview in 2019. I have received email from US C.I.S. saying my case has been reaffirmed/reapproved.

The email is telling me to resubmit all my documents for another interview.

My question is, my daughter turns 21 in four months,  she will age out, therefore not be eligible for the green card if we are approved?

Also, she is attending university in Canada and is in only her second year, (she will be attending the consulate interview ) how would we go about ensuring she can get her visa and keep her green card but continue with her studies?

thank you

Flag it there’s age out potential so they can get you in before she turns 21.

I-131 (re-entry permit) should be filed so she can return without problems. Does have to be in the US to file it and do biometrics.

Thanks when you say flag it do you mean mention it somewhere on the DS 260? because it’s impossible to get in contact with the consulate? Or what’s the best way to flag it?

After scheduling first available slot, you get in touch either via phone call or online form.  You ask for expedite if interview on the grounds of dependent aging out - they’ll then get in touch with consular to get approval for it.

Thank you, another question does the Child status protection act (CSPA) cover her? I.e. her age freezes at the date of filing of I140 due to this act?

It’s actually when DS-260 is completed as far as I know.

Someone correct me if I have the wrong info.
