Hello everyone!
I have two questions if you can help me

 

1. My husband did not meet the minimum poverty level on his most recent taxes because he did not work all of last year; but this year he is working full time and with a good salary that is above the poverty line. Can he still sponsor me?

 

      2. We filed paperwork with a co-sponsor, but got an rfe for not filing all taxes. then we got what we needed to send again. The problem is that the co-sponsor retired from employment yesterday before reapplying. Would this affect the documents we already have? because he's still supposed to have a job. Would it be better to find another co-sponsor? or for a few days of withdrawal there are no problems?

Yes, assuming his last regular pay check's gross pay multiplied by the number of pay periods per year exceeds the poverty threshold.

I think you need a new joint sponsor.

I’m curious if  OP’s web browser  is auto translating from  English to Spanish. Nice feature for reading content. Not so nice for replying to content. Perhaps there are ways to set up a browser to not translate content. @Captain Ewok

I am sorry. I think translating the page has generated all these errors. I speak Spanish.
I just need to be sure. If my husband can be my sole sponsor since he currently earns above the poverty line, regardless of whether 2021 taxes do not exceed that limit.

Is this current job a W-2 job or a 1099 job?

Legally a joint sponsor isn’t needed though an officer has discretion might still require a joint sponsor.

for cosponsor it would depend on his current income also 

Retirement from his job,    401 K savings for his retirement and /or SSA benefits 

retirement does not mean he is now  disqualified

Yes, as long as he makes above the poverty line and has proof of such. Just be aware that the CO may still ask for a joint sponsor, depending on the circumstances.


P.S. The spouse is always the main sponsor, regardless of income.
