Hi

I am US citizen and would like to file for green card (Family Fourth Preference (F4)) for my sister.
My sister is a Canadian citizen since March 2004, her country of birth is India. She is legally in US on TN work permit as a Computer System Analyst (valid upto Sep 2024). 

 

What is the process for filing green card in this case.

Do I need to start this process after her TN duration is completed.

Can she as a Canadian citizen visit /enter US while the green card is processed.

You file the I 130

No

Well the Green Card will not be processed for many years but if you mean whilst waiting for her Priority Date to be current.yes.

You are aware it is likely to take 15 or more years before she gets a green card via F4? Speaking from personal experience,  someone who shows ties to home shouldn’t have a problem visiting the US in the interim with that kind of long-term petition.

It is 17 years and I am still waiting for a F4 visa for my sister! Her PD is 11th October 2005! It hasn’t moved a bit in over a year

15 or more probably nearer 30
