Okays, here's my situation:

Got married 3 weeks ago to my US fiance (now wife).

Got all of the adjustment of status paperwork completed and posted off yesterday. This followed exactly the guidleines on Visa Journey.

Now - I contacted the Immigration people by phone a couple of weeks ago and I happened to ask them how soon I was allowed to work - I was informed that i could work based on the K1 visa in my passport. However, I have read elsewhere that this is not the case. Plus - in order to work in the US, don't I need a social security number?

Can anyone else shed some light on the whole working issue around this point in the process. I want to get started working as soon as possible so i can be bringing in money, but don't want to start working beforwe I have permission.

Some questions:

1. How long does it take for the EAD to come back?

2. Can you work with just a K1 visa in the passport, whilst waiting for the I765 form to be approved?

3. Any links or pointers would be a huge help at this point.

As a K-1 visa holder you are allowed to work 90 days after arrival in the US if you got the stamp in your passport when you entered the country.

YOur EAD processing time can vary, but usually 70-90 days, I am assuming it can take a little longer since so many people have been filing this month to beat the fee increases.

About your SSN...I would think you need a SSN in order to be able to work, but I am not sure...also I think you can't get a SSN after you got married if you don't have your gc yet.

As far as I know, you should have applied for a SSN before you got married....someone please correct me if I am wrong.

Can you please fill in your timeline?

Apply for your SSN asap. If you're too close to the end of your 90 days since entry (I think the cutoff is 75 days... someone correct me if I'm wrong), they will not issue you an SSN and you'll have to wait until you have a GC or EAD to get an SSN.

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

An oft discussed, much misunderstood subject.

Being careful with my words, you can work until your I-94 expires, if you've applied for a SS card (you've got 90 days to get it in-hand), but an employer cannot hire you unless your I-94 was stamped 'Employment Authorized' by the CBP officer when you entered the USA. So you are allowed to, but as a practical matter you can't.
