URGENT: Need help preventing fradulent visa from proceeding

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Best thing for your sanity and safety is to send that email to the consulate, print it out, sign and put it the post…then find a safe place to make your calls. 


They have an emergency line for US Citizens with a dedicated officer and they promise a call back within 24 hours…just say you are in distress.

 

I cannot imagine how things between you two went so bad , so fast ….or why you are calling fraud . I can imagine a world of hurt in instances of betrayal, infidelity ( the usual suspects) and no one would fault you for just calling it off if you had a change of heart for any reason ….but why call fraud?

I wouldn’t put too much faith in the possibility of getting through by phone.   Maybe the consular section at the Peru embassy is well staffed and available, but I’d email for sure.   Also good to have something in writing and date/time stamped.

This would be the U.S. Citizen Services unit; the consular unit might operate differently.  Just make sure that you get in, that you hand the letter personally to an officer in the Immigrant Visa unit or at least to an LES (locally engaged staff) member, and that you get as much identifying information about that person as possible.  Write that down with the time and date of the action.  Follow up with an e-mail to the IV unit in which you confirm what you did during this described process.

 

Of course, let us know what happens.

Citizen services would presumably help if they needed to. I can’t imagine anyone at the embassy wants to see someone get a visa under false pretenses.

My thoughts as well.   Like Family said, he’s a USC in distress, and they are obligated to try and help, even if that is routing him to a different person at the embassy.

Perhaps, but the two sides aren't always connected.  The OP should play the "American citizen" card if he's stonewalled:  "Are you a US Citizen?  No?  Well, I am, and I urgently need to be connected to a consul in the IV unit who is physically present to answer the phone."  If still blown off, the OP can ask for the employee's name and supervisor's name, and request the supervisor's transfer of the call to the IV unit.  (This in itself may enable the transfer.)

One would surely hope not, but the cavalier attitude of some of these local staff can prove to be a challenge.

If they receive your email that you guys are no longer together, Embassy wont cancel her interview rightaway or what , they will let her in and do her interview, and they will ask her if you guys are still together and still talking and if she lies and say yes while they know the truth they will handle her a denial with 221g. And keep her passport in order to see if you guys can still work it out or give it to her back , but if its a withdrawal they will but my fiancé didn't brought about withdrawal. It was only canceling but they kept me under administrative for a time

But it's very stressful and heartbreaking
