Affidavit of Support I-864 questions

Timeline

Good morning all,

A friend is filling out form I-864, because she is the petitioner for her husband.

They both live abroad (Sweden) and have two kids. She does not work, and I will be their co-sponsor.

 

1- Part 5: Sponsor's household size: does she need to list the two kids as dependents, knowing that she does not work.

2- because she lived abroad for the last 10 years, she did not file taxes as she does not have any income, would a letter explain that be enough to avoid an RFE?

1. she still fills out the I 864 with 0 income

yes,  the kids are household residents as she is (family is 4) plus u as joint sponsor

2. she should ask for the following

 

An IRS Verification of Nonfiling Letter (VNF) will provide proof from the IRS that there is no record of a filed tax form (1040, 1040A, or 1040EZ) for the year you have requested. A VNF does not provide proof that you were not required to file, only that you did not file.
