Hello again guys, looks like I am going to be June filer, hope it gets there okay, I'm not sure if the fee increases affect those who send it off BEFORE july 30th or if it gets there after july 30th, I am assuming the former.

My question is, both my grandparents are sponsoring me, and so they filled out two separate I-864's affidavit of support, to combine their income.

My grandparents are married and live together here in the US and are both US citizens

1) do i need two I-864's from them, or just one with a joint federal tax return

2) If they do need separate forms, do they go down as "I am the First/Second of two joint sponsors?" or "I am the only joint sponsor"

I am pretty sure I know the answer, but it doesn't hurt to get a second opinion.

My final question is that my wife, my petitioner, only has a federal tax return for last 2 years, not three. Does this cause a problem? What do we do in this case?

Thank you in advanced

Are they using the income test or the asset test for sponsorship? If they use the asset test and hold assets as individuals rather than as a couple, then it would seem two I-864's would be required. But, assuming they can use the income test then one would be sufficient.

I see, no they are combining assets so I think two are needed.

I have a problem though, My wife only has current and previous year's federal return, as before that she was combined with her family's income tax return. I'm not sure what to do here

Can i just include recent and year two? Or will they not accept that?

yikes

I only had the last two years tax returns (my dad was joint sponsor) since I didn't work the third year back, and I just noted that with my form that I only had to years since I wasn't employed that 3rd year.

Filed: Timeline

MATTOB,

Read the instructions - 1 Joint Sponsor.

One grandparent prepares an I-864 showing both grandparent's financial resources. Both grandparents jointly execute an I-864A giving the sponsoring grandparent the right to use the other grandparent's resources.
