Hi all,

I am trying to gather all documents to file I-751 for my wife. Her green Card expiration date is 09/12/2007.

1. Please some tell me if I am not really late on process. I am just worried if I don’t get extension before expiration date.

2. for Affidavits supports letter,

Can I just use my brother and brother-in-law's letter? OR Do I need someone other then family member?

Do I just notarize the letter or something else to make it affidavit?

07/24/2007 - TSC received at TSC

08/14/2007 - Check cleared bank.

Reading from Check:Transfered to CSC. WAC case number assigned.

Affidavits are a last-ditch effort at providing something for people who have nothing at all to offer in the way of evidence of the marital relationship.

So, what have you got that's really useful?

You're not late yet. You're allowed to file any time within the 90 days preceeding the expiration date, with no penalties or explanation needed as long as you file sometime during that window. It looks like the window opened about 6/14/2007, so you're a little more than a month inside the window now. The window will close on 9/12/2007. Most people recommend filing as early as practical inside the window, just to allow time for the mail system, to allow time to get the NOA, and to allow for any unforseen delays.

It'll normally take a few weeks after you file to get the NOA. If you file on time and the NOA arrives after the green card expires, it doesn't mean you're out of status, but it does leave you with no way to PROVE your status. This could be a problem if you needed to travel internationally. So it's good to file at least a month before the GC expiration date, the sooner the better.

So don't wait much longer. I'd recommend gathering the package together very soon, probably this weekend. But don't panic about being late.

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.
