If he is residing illegally there, he will not be able to interview for a US immigrant visa, no.

He has to return to his country of citizenship. There’s also an issue of police certificates, as you know you need to submit one for the places you lived. Not sure if France issues them for undocumented immigrants, he should look into that before departing

So your fiancé is an illegal immigrant in the USA?

 

If so did he enter the USA legally  an overstay or enter illegally?

1) Where is he from?

 

2) Where did he file for asylum?  In France or in USA?

 

3) If he applied for asylum in US and was denied, is he legally residing in France?

 

4) Does he have a passport?

You can file for him. But, he will have to interview in his home country as he isn't doesn't have residency in France. 

You should also check to see if he is able to obtain a criminal background check from France.

A member a few months back had this issue. I can't find the link right now, but the partner had already left the country in question. They applied for the CBC from the partner's home country and they got the visa.

Sounds more like he's in France illegally, after many failed asylum petitions.  (Asylum to France from some other country).

Criminal Background Check. 

As your partner has lived in France for more than a year they need to provide a criminal record from that country. 

In France is it is called Extrait de Casier Judiciaire. 

 

Your partner should have no issue obtaining one: 

 

Procedure for Obtaining:  Extraits de Casier Judiciaire may be obtained by any person, regardless of: nationality, place of birth, legal/illegal status, who has resided in France at any time, provided such residence occurred after the age of 15 years. The applicant should furnish his/her full name, and any other names (including maiden), by which known, date and place of birth, father's full name, mother's maiden and married names, and place of residence.

He won't be able to interview in France though because he is not a legal resident. He needs to return to his home country or another place he can establish residence for the medical and interview.
