Hello,

 

I am a US Citizen and have filed an immigration petition for my parents. The case is now at the NVC, and I have a few questions about Affidavit of Support.

 

  1. My wife and I file taxes as married filed jointly, so if I submit the return transcripts from IRS, it will demonstrate the combined income, and there doesn't appear to be a line item that shows individual income. My individual income is sufficient and well above the poverty guidelines. In that case, do I have to add her as a joint sponsor, or can I be the only one submitting the AOS and include the 1040 as a supplement to IRS Return Transcript?
  2. If my wife is not a joint sponsor, but since we reside in the same household, does she have to sign I-864A Contract Between Sponsor and Household Member?
  3. I have multiple sources of income (W2, Rentals and Business), however, my W2 income suffices and is well above the poverty guidelines. Can I file I-864EZ with just W2 Income mentioned?
  4. In I-865EZ > Part 5 >  Item 4 > My Current Individual Income, if I am including only the W2 income, should this match (or be around) the previous years W2 income?

Personally, I would fill out the regular I864 yourself, and have you wife fill out the I864A even though your finances are joint.  Apparently, NVC and consulates are asking for the I864As now.
