Hello Everyone,

 

Almost 6 months ago, my fiancé emailed USCIS if they can transfer our case to Canada embassy instead of my hometown due to backlogs of cases. We didn't receive any response from them. But now we got an email from NVC stating our petition has been transferred Montreal. I want to know can I give my K1 interview in Canada while on a visitor visa.

Thank you for the response. Do you know if I need police clearance certificate from CANADA as well? I'm planning to enter Canada closer to my interview date.

Montreal will not allow it on a visitor status.

However, OP states that he was told it was  granted, and sent to Montreal?   Kind of a confusing situation.

https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/wait-times.html suggests that the state department policy has changed  to allow any available consulate to take the interview

He did not ask Montreal. He requested it at USCIS. Montreal will want to see proof of legal status and visitor visa is not one they will accept.

That is interesting, as just recently booked appointments they are still asking for proof of status in Montreal. 

 

If the OP's fiancé gets to interview in Montreal he needs to understand it will not be fast to get the visa from Montreal. She will almost most certainly get hit with the ds-5535 and some have been waiting a a year since interview and still no word on when hey will be approved.. The only way out seems to sue them.

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Yes, and there is a lengthy thread on the Canada forum about the inordinately high numbers of 5535s issued out of Montreal. Some are taking close to a year.

Personally, waiting for your home embassy would be preferable to taking a chance at Montreal.
