Update on I-485 RFE for medical and I-129F

Yesterday I got some info from my congressman's office - my wife has a temporary file at MSC - her paperwork from the POE has not yet made it to their office. Actually her file is at another office miles away from MSC and should connect up in the next week. I'm guessing that's part of the reason for the full medical exam request, they don't have any paperwork on her medical. It still doesn't answer why we were asked again for a copy of the I-129F approval, as it was provided with our application submission.

So what's the conclusion here? Was AOS filed too soon? My wife arrived 14 April and we filed 16 Jun and the RFE was dated 6 Jul - too fast for USCIS to get paperwork in the right place?

The request for the I 129f approval could just be because they lost it.

I hope the early filing after POE doesn't bite us, either. Guess we'll just have to wait and keep our fingers crossed!

So do you not need the medical any more? We got a medical RFE too and our turn around time was short(entered in Feb, AOS in April). Then again, our case was transfered to CSC so I was surprised the medical didn't get spotted sooner. We got CC'd on a letter our congressman sent to USCIS in DC.

If you entered on a K visa, and your overseas medical was less than a year ago, you are NOT required to have another full medical.

Yes, which most of the time seems to be because they haven't received the file from POE that contains the medical information. So they RFE for it because they DO need proof that you either had it overseas, or had one here by a CS, before they will approve you.

Edited to add - I DO think its out of order for them to expect you to pony up $200/300 to a CS for something that they've either misplaced or not yet sent to the right location. Hence calling your congressman to help find the original is not a bad idea.

For you and the other posters: We're waiting for the file to catch up and then the congressman's staffer will find out about the medical. I'll have more info on or about July 30. We cancelled the Infopass after getting this info.

Timeline

I have yet to hear from Sen. Chuck Schumers office since i sought their assistance well over a month ago. I too had an rfe for the full medical and finally buckled and got it done yesterday. $185 - could have been worse. There was a civil surgeon in China Town that would ghave done it for $100 but i thought it sounds too risky.

So i go to pick up the sealed envelope on monday and i will mail it out tuesday morning. Hopefully that is all thats holding up my AOS.
