[London] I got the 221(g) and have been requested to provide my partners (the petitioner) divorce certificate - does anyone have any experience with this or are able to tell me what to expect? (merged)

1. Was the divorce certificate provided in the I-129F?

2. Did the petitioner’s ex spouse pass away?

3. Did the petitioner’s ex spouse petition someone for an immigration benefit?

If you have evidence the RFE response from  you was delivered then I suggest traveling to the USA as soon as possible since the visa is in hand.

1 - I thought so but I can't remember if it was a certificate, or a divorce decree (and tbh I don't really know the difference) - we submitted in May 2021 and I never saw it in person but I'm sure we submitted something related to the proof of divorce but the guy who interviewed me didn't seem to find it on the day of my interview.

2 - No

3 - No

Well maybe the CO decided what was provided in I-128F sufficed. Get on the plane now.

I have to give notice at work I plan to travel in around 4-5 weeks. Thanks.

Given the strangeness of these events, only you can  balance the cost burning a bridge with your employer versus the risk of the embassy rescinding the visa.

The embassy is not going to rescind the visa. I think you are alarming the OP for no reason.

Thanks - I am a little nervous, but also excited and seeing the visa in my passport is really nice after the long wait.

Is this relatively common? I can't think why they would have changed their mind on the 221(g) unless they had another look through our petition documents and found that what we submitted for proof of divorce was enough.

I also hope that the document I sent them won't re-open the case and interrupt anything, though I guess it shouldn't.

This is not common. A typical K1 interview in London only wants the beneficiary’s documents.  I think the interviewing officer just made a mistake. The divorce decree  copy provided with the petition should have been sufficient proof that the petitioner’s marriage ended. I think the 221g was in error and when when the case was reviewed after the interview by maybe a supervisor, it was all deemed complete and  fine and passed on to be issued and printed. So no worries that I see.

My personal K1 experience in London and further on to Adjustment of Status and US citizenship— No original  of my petitioner’s birth certificate or the death certificate proving her first marriage ended were ever viewed in person by an immigration official.. The photocopies of both were all accepted.

For me:

21 October - I had the interview, got a 221(g) and asked to submit the divorce certificate of my partner (the petitioner)

25 October - My visa was issued

26 October - I submit the divorce certificate they had asked for, courier told me it would be with them in a day.

27 October - I received the visa in the post today, issue date 25th October.

I hope you are asking this question while in the US
